This past year has seen a whirlwind of new FCC regulations and, in some cases, state legislation, limiting local governments' ability to manage wireless facilities in the public rights-of-way. The FCC's Third Report and Order of 2018 has altered the regulatory landscape and has forced local governments to change their methods of managing these facilities. This session will address the key highlights and local interpretations of the Order, the status of the litigation challenging the Order, and will conclude with recommendations for asserting municipal rights to manage the rights-of-way consistent with current federal and state law.
